使用TRI新房及TRI的服务，您应当阅读并遵守本《TRI用户服务协议》（以下简称“本协议”）。本协议是用户与TRI之间的法律协议，是用户注册TRI账户并使用TRI平台服务，或未经注册程序直接使用TRI平台服务时的通用条款。请您务必审慎阅读、充分理解本协议各条款，特别是免除或限制责任、管辖及法律适用的条款。限制和免除条款可能会以加粗或下划线形式提示您特别注意。如果您不同意本协议的条款，您应立即停止注册程序或停止使用TRI平台服务；如果您继续访问和使用TRI平台服务，则视为您已确认并完全同意本协议的条款。
一、定义
1.TRI平台是指上海蓝思信息技术有限公司及其关联公司运营的TRI房源导航、新房交易看价、TRI房源查价、二手房源看价微信小程序、H5界面、网站、“TRI”、“TRI问答”、服务号或视频号以及TRI手机应用软件（APP）。TRI平台是一个致力于为用户提供房产信息搜索服务、网络推广服务及相关衍生服务的互联网平台。
2. User, hereinafter also referred to as "you", refers to civil subjects such as corporate legal persons, social groups, natural persons or other social organizations with full civil rights and capacity for conduct who register or log in to the TRI platform to use TRI products or services. Registered users refer to users who use TRI platform services or TRI platform information after completing all registration procedures through the TRI platform. According to the way users use TRI services, they are divided into corporate users and consumer users. Among them, corporate users refer to entities that publish real estate information, promote online or provide other services to consumer users on the TRI platform through the One House One Thousand Platform. Corporate entities may use other backend systems provided by the TRI platform, and their usage rules are separately stipulated. Consumer users refer to the entities that search for real estate information through the TRI platform or use other TRI services.
3. Parties to the Agreement. The parties to the Agreement include Shanghai Lansi Information Technology Co., Ltd. and its affiliates that provide technical services, consulting services, and information services to the TRI platform as one party, collectively referred to as "TRI" or "TRI platform", and you as the other party.
2. Validity of the Agreement
1. After you fill in the information as prompted on the registration page, read and agree to this Agreement, and complete all registration procedures, or actually use the TRI platform services in other ways permitted by TRI, you will be bound by this Agreement.
2. The content of this Agreement includes the text of this Agreement. When you use a specific service or system of TRI, the service may have separate agreements, relevant business rules, announcements, help, instructions, general terms, etc. (hereinafter collectively referred to as "Rules"). All rules that TRI has published or may publish in the future are an integral part of this Agreement and have the same legal effect as this Agreement. Unless otherwise expressly stated, any service provided by TRI and its affiliates (hereinafter referred to as "TRI platform services") are subject to this Agreement. You promise to accept and abide by the provisions of this Agreement. If you do not agree to the provisions of this Agreement, you should immediately stop the registration process or stop using the TRI platform services; if you continue to access and use the TRI platform services, it is deemed that you have confirmed and fully agreed to the contents of this Agreement.
三、注册
1. 您确认，在您完成注册程序或以其他TRI允许的方式实际使用TRI平台服务时，您应当是具备相应民事行为能力的自然人、法人或其他组织。如您不具备前述主体资格，则您及您的父母或法定监护人（以下统称“监护人”）应承担因此导致的一切后果，且TRI有权注销您的账户并向您及您的监护人要求赔偿。
2. TRI高度重视保护未成年人个人信息收集和使用的安全。任何未满18周岁的未成年人参与网络活动，均应事先取得其监护人可验证的同意，并遵守《全国青少年网络文明公约》。监护人应对未成年人网络活动的风险及未成年人相关网络隐私的保护承担主要责任。
3. 当您签署本协议并完成注册程序后，TRI将为您提供一个唯一编号的TRI账户。您应对您的用户账户、登录密码、支付密码（如有）、验证码以及通过您账户进行的操作的安全负责。除非法律规定或行政、司法机关的指示，且经TRI同意，您的用户账户不得以任何方式转让、借出、赠与或继承（账户相关的财产权利除外），您的登录密码、支付密码（如有）及验证码不得向任何第三方提供或披露。否则，因此给您（或TRI、任何第三方）造成的一切损失均由您自行承担（或负责赔偿），TRI不承担任何责任。
4. 如您发现任何人以不当方式使用您的账户或存在其他可能危及您账户安全的情况，您应立即联系TRI客服，通知TRI暂停或冻结相关服务。您理解TRI对您的请求采取行动需要合理时间，TRI对采取行动前已经产生的任何后果（包括但不限于您因此造成的任何损失）不承担任何责任。
四、交易
如您使用TRI提供的网上交易服务，您知悉并自愿以电子合同服务的方式签署本合同（或协议），接受并确认通过TRI平台签署的电子合同（或协议）与纸质合同（或协议）具有同等法律效力，并接受并确认您的电子签名与您的手写签名具有同等法律效力。您同意并不可撤销地授权乙方如下：
1、当您向乙方申请开通第三方服务（包括但不限于钱包服务、电子合约服务、个人履约信息服务、金融产品服务、第三方支付服务等）时，即视为您同意并授权我们将您的信息提供给与TRI合作提供该等服务的第三方。您的信息包括但不限于您同意向TRI平台提供的信息（例如个人信息、甲方向乙方提供的征信信息、甲方的CA数字证书信息等）以及您在TRI平台上录入的信息。
2.授权TRI及其合作的第三方通过合法途径查询或核实您的信息（法律法规及监管政策禁止的查询除外），并有权根据您使用TRI的需求对所获取的信息进行保存、整理或处理。TRI及其第三方可能基于前述信息向您提供相应的服务（包括但不限于利用该信息向您进行推广、提供其他更优质的产品或服务）。您应自行承担因您提供的信息不真实或无效而导致的一切法律责任。
3、授权TRI及提供电子合同服务的第三方根据您向TRI提供的信息开通电子合同服务（您须先通过TRI及其第三方进行的合法有效的实名认证，并获取相应的CA数字证书），并生成电子印章。授权TRI及提供电子合同服务的第三方保留您在使用电子合同服务过程中或终止电子合同服务后产生的相关信息数据。
4.授权TRI以您的名义开立第三方支付账户，支付您与TRI签约方签订的合同项下的相应款项，并向TRI支付其他服务费用。TRI向您提供的付费服务将在平台上公示，您可以自行选择。
5.您在TRI平台上的账户和密码是我们识别您及您指令的唯一标志。所有使用您的账户和密码进行的操作（包括但不限于信息披露、信息发布、问卷填写、申请人工客服、留存联系方式、点击同意或提交各类规则协议、签署电子合同、订阅推送、查询计算等）均属于您或您授权的操作。任何使用您的账户和密码向TRI或其合作的第三方发出的指令均构成您不可撤销的授权指令，TRI及其合作的第三方对根据该指令进行的操作及结果不承担任何责任。
6. 您与房地产经纪机构、开发商、现有房主、购房者、承租人或任何提供房地产交易服务的第三方进行交易时，应当遵守相关法律法规及规范性法律文件，包括但不限于《商品房销售管理条例》《房地产经纪管理条例》等法律法规及规范性法律文件。TRI仅作为房源信息展示平台，不提供任何与房地产交易相关的中介服务，也不参与任何与房地产交易资金直接相关的活动。TRI平台对前述服务主体的承诺或行为不作任何明示或暗示的保证，亦不承担任何责任。
7、如您发现账户有任何异常操作，请及时联系我们的客服。
五、TRI平台服务使用规范
1.通过TRI平台，您可以按照TRI的规则发布信息。但发布的信息不得包含以下内容：
1）反对宪法所确定的基本原则，煽动抗拒、破坏宪法和法律、行政法规实施的；
2）煽动危害国家安全、泄露国家秘密、颠覆国家政权、推翻社会主义制度的；
3）煽动分裂国家、破坏国家统一、损害国家荣誉和利益的；
4）煽动民族仇恨、民族歧视，破坏民族团结的；
5）捏造、歪曲事实，散布谣言，扰乱社会秩序的；
6）进行政治宣传或者破坏国家宗教政策，宣扬封建迷信、淫秽、色情、赌博、暴力、凶杀、恐怖、教唆犯罪的；
7) 公然侮辱他人或者捏造事实诽谤他人，或者进行其他恶意攻击；
8）损害国家机关声誉的；

2. In the process of receiving TRI platform services, you shall not engage in the following acts:
1) Publish, transmit, disseminate, and store content that infringes on others' intellectual property rights, trade secrets, and other legal rights, including viruses, Trojans, time bombs, etc. that may cause damage to the 1F10,000 system or affect its stability, and create false identities to mislead or deceive others;
2) Transmit or distribute files containing images, photos, software or other materials protected by intellectual property laws that are transmitted by other means, as examples (but not limited to): including copyright or trademark laws (or privacy or publicity rights), unless the user owns or controls
3) Use any data or information containing images or photos obtained by using the "Software" in a way that infringes trademarks, copyrights, patents, trade secrets or other proprietary rights of any party;
4) Conduct acts that endanger computer network security, including but not limited to: using unauthorized data or entering unauthorized servers/accounts; entering public computer networks or other people's computer systems without permission and deleting, modifying, or adding stored information; attempting to explore, scan, or test the weaknesses of the platform system or network without permission, or other acts that undermine network security; attempting to interfere with or undermine the normal operation of the platform system or website, deliberately spreading malicious programs or viruses, and other Acts that disrupt or interfere with normal network information services; forge TCP/IP data packet names or partial names;
5) Modify or forge instructions, data, or data packets in the operation of software works, add, delete, or change the functions or operating effects of software, and do not disseminate or operate software used for the above purposes to the public through information networks;
6) Sell, rent, lend, distribute, transfer, or sublicense software and services or related links, or profit from the use of software and services or the terms of software and services without TRI's written authorization, regardless of whether the above use is direct economic or monetary gain;
7) Violate the activity rules published on the TRI page, including but not limited to publishing false information, cheating, or conducting false transactions through other means.
3. You understand and agree that TRI has the right to provide necessary information such as the registration information and release records you fill in on the TRI platform to government departments (including judicial and administrative departments) at their request.
4. You understand and agree that in order to provide you with effective services, the TRI platform may use the bandwidth resources of your terminal equipment, and data traffic fees may be incurred during use. You need to obtain relevant tariff information from the operator and bear the relevant fees.
5. When using TRI platform services on the TRI platform, you promise to abide by the following agreements:
1) All actions implemented in the process of using TRI platform services shall comply with the provisions and requirements of national laws, regulations and other normative documents and various rules of the TRI platform, shall not violate the social public interest or public morality, shall not infringe the legitimate rights and interests of others, and shall not violate this agreement and related rules. If you violate the above commitments and any legal consequences arise, you shall bear all legal responsibilities independently in your own name and ensure that TRI is free from any losses or increased costs.
2) Do not publish information prohibited by the state (unless legal and sufficient permission is obtained), do not publish information suspected of infringing on the intellectual property rights or other legitimate rights and interests of others, do not publish marketing information that violates local relevant regulatory policies, do not publish information that violates the social public interest or public morality, public order and good customs, and do not publish other information suspected of violating the law or violating this agreement and various rules.
3) Do not make commercial use of any data on the TRI platform, including but not limited to using the materials displayed on the 1Fang10,000 platform website in any way such as copying and dissemination without the prior written consent of 1Fang10,000.
4) Do not use any device, software or routine program to interfere or attempt to interfere with the normal operation of the TRI platform or any activities being conducted on TRI. You shall not take any action that will cause an unreasonable large data load to be imposed on the TRI platform network equipment.
6. You understand and agree that:
1) If you violate the above commitments, TRI has the right to make corresponding treatment or terminate the provision of services to you in accordance with the provisions of this Agreement, without obtaining your consent or notifying you in advance.
2) According to the designation of relevant laws and regulations or the judgment of the TRI platform service rules, if your behavior is suspected of violating the provisions of laws and regulations or violating the terms of this Agreement and/or rules, TRI has the right to take corresponding measures, including but not limited to directly blocking, deleting infringing information, reducing your credit value or directly stopping the provision of services.
3) For your actions on the TRI platform, including actions that you have not implemented on the TRI platform but have already affected the TRI platform and its users, TRI has the right to unilaterally determine the nature of your actions and whether they constitute a violation of this Agreement and/or rules, and take corresponding measures accordingly. You should keep all evidence related to your actions by yourself, and bear the adverse consequences of failure to provide sufficient evidence.
4) If your suspected breach of promise causes damage to any third party, you shall bear all legal responsibilities in your own name and ensure that TRI is exempt from any losses or increased expenses incurred thereby.
5) If you are suspected of violating relevant laws or the provisions of this Agreement, causing TRI to suffer any losses, or being claimed by any third party, or being punished by any administrative department, you shall compensate TRI for the losses and (or) expenses incurred thereby, including reasonable attorney fees.
VI. Data Protection Clauses
1. The TRI platform operator is the owner and intellectual property rights holder of all information content presented on this platform, including but not limited to program code, interface design, layout framework, data, account, text, pictures, graphics, charts, audio, video, etc. At the same time, the TRI platform operator has full rights to all data and information generated by all TRI platform operators and their affiliates and partners in the process of service development and operation. The above rights are subject to the exception of the content that should be enjoyed by the relevant right holders in accordance with laws, regulations or agreement constraints.
2. Without the written permission of TRI operator, you shall not, by yourself or authorize, allow or assist any third party to conduct the following actions on the information content of this platform:
(1) Copy, read, adopt or unilaterally intercept the information content of this platform for commercial purposes including but not limited to publicity, increasing reading volume, browsing volume, exaggerating market trends, one-sided marketing, etc.;
(2) Use identification methods including but not limited to special logos, special codes, etc. to, by yourself or assist a third party, generate adverse effects such as traffic flow, reading volume guidance, transfer, hijacking, etc. on the information or content of this platform;
(3) Scan and/or detect this platform and its system by address scanning, network port scanning, operating system detection, etc., or monitor, Unauthorized acquisition and use of any content on this platform by copying, disseminating, displaying, mirroring, uploading, downloading, etc.;
(4) Using automated means or obviously different from ordinary people, and far higher than the frequency of normal users to post comments, private messages, articles, or follow, like, crawl (access, crawl) data, etc.;
(5) Copy, modify, add, delete, mount or create any derivative works (information or content) of the data released to any terminal memory during the operation of this platform and its software, the interactive data between the client and the server during the operation of the software, and the system data required for the operation of the software, including but not limited to the use of plug-ins, external plug-ins or third-party tools/services not authorized by Yifangyiwan to access the software and related systems.
(6) Other illegal acquisition and use of information content on this platform.
3. With the written permission of TRI, your sharing, forwarding and other behaviors of the information and content of the platform services (when you use the services provided by this platform) shall also comply with the following specifications:
(1) The crawled, counted and obtained relevant search hot words, classifications, rankings, search volume, click-through rate, reading volume and other related data shall not be publicized, provided or leaked to any third party in any way without the prior written consent of the company;
(2) The source web pages of this platform shall not be modified in any form, including but not limited to the homepage of this platform, various functional interfaces, advertising system links and other entrances, nor shall any form of blocking, insertion, pop-up windows or other obstructions be made to the display of the source pages of the service;
(3) Safe, effective and strict measures shall be taken to prevent the information content of this platform from being illegally obtained by third parties through any form, including but not limited to "spider" programs;
(4) The data content of this platform shall not be used for purposes beyond the scope of the written permission of the TRI operator, for any form of sales and commercial use, or for any form of disclosure, provision or permission for any third party to use in any way.
(5) You shall strictly abide by the Robots Agreement issued by the TRI operator on this platform. You shall not access the platform or collect any content in any way that violates the above provisions by yourself or by entrusting a third party.
VII. Scope of Liability and Limitation of Liability
1. TRI is responsible for providing you with TRI platform information services and related services. However, TRI does not make any express or implied guarantees for TRI platform services, including but not limited to the accuracy, applicability, lack of errors, omissions or suitability for a specific purpose of TRI platform information services. TRI shall take appropriate measures to protect the security, stability, continuity and reliability of the TRI platform.
2、TRI仅向您提供TRI平台信息服务。您理解TRI平台上的信息均由用户自行发布。由于海量信息的存在，TRI平台无法消除可能存在的风险和瑕疵。您应当谨慎判断相关信息的真实性、合法性和有效性，并注意保留相应证据，以便于维权。
3. 与其他在线网站一样，TRI平台也容易受到各种负面信息、网络安全和网络故障问题的影响，包括但不限于：
1）其他用户发布欺诈、虚假信息，或发表侮辱、咒骂、诽谤、攻击等令人反感、令人厌恶的违法言论；
2）其他用户可能发布侵犯您或其他第三方的知识产权、肖像权、姓名权、名誉权、隐私权和/或其他合法权利的图片、照片、文字等材料；
3）面临黑客攻击、计算机病毒问题、系统崩溃、网络断线、网速慢、程序漏洞等问题和威胁。
您充分理解并同意，前述各类负面信息、网络安全及网络故障问题均非TRI或TRI平台原因所致，且可能给您带来厌恶、反胃等精神损害，或造成您的其他损失，该等损失应由您自行承担，TRI不对您承担任何责任。
4. 您同意，如您发现本平台任何内容不符合法律规定或本用户协议的规定，您有义务及时通知TRI。如您发现您的个人信息被盗用或您的版权或其他权利受到侵犯，请立即告知TRI并提供以下信息和资料：
1）侵犯您权利的信息所在的URL、数量或其他详细信息；
2）您作为版权或其他权利合法所有者的权利证明；
3）您的个人信息和有效联系方式，包括真实姓名、身份证号码、住址、电话号码和电子邮件地址；
4）您的身份证、营业执照等相关资料的复印件。
如经审核确认，我们将及时删除相关信息。我们仅接受通过邮件、电子邮件或传真发送的书面侵权通知。如遇紧急情况，您可以通过客服电话提前告知我们，我们将根据情况采取相应措施。
5.您理解并同意，TRI无需对因下列任一情况而给您造成的任何损害承担责任，包括但不限于利润、商誉、使用、数据等的损失或其他无形损失：
1) 使用或未能使用TRI平台服务；
2）第三方未经授权使用您的帐户或更改您的数据；
3）通过TRI平台购买、推荐、获取任何服务、数据、信息等或采取替代行动或与任何其他第三方建立线上/线下交易、服务法律关系而产生的一切事项所产生的费用及损失；
4）您对TRI平台服务的误解；
5）因不可抗力或其他非因TRI原因造成的与TRI平台服务相关的其他损失。
6、您在TRI上使用第三方提供的产品或服务时，除遵守本协议的规定外，您还应遵守该第三方的用户协议及其他相关规则。对于可能产生的纠纷，TRI与该第三方应在法律规定和约定的范围内各自承担责任。
7.您同意，在使用TRI平台服务过程中，TRI或第三方服务商向您发送或提供的推广或宣传信息、资讯、动态等（统称推广信息，包括商业和非商业信息）可能会被展示，且其展示方式和范围可能会有所变更，而无需向您特别通知。除法律法规明确规定外，您应当审慎评估、理性接受基于该等推广信息进行的交易，并对交易后果负责。对于用户因基于该等推广信息进行的交易或前述第三方服务商提供的内容而遭受的任何损失或损害，TRI不承担任何责任。
8、因下列不可抗力事件，TRI免责：信息网络正常的设备维护、信息网络连接故障、电脑、通讯或其他系统的故障、电力故障、罢工、劳动争议、暴乱、起义、动乱、生产力或生产资料不足、火灾、洪水、风暴、爆炸、战争、政府行为、司法行政机关的命令或第三方的不作为而造成的服务不能或延迟。
9、您应当严格遵守本协议及TRI规则等。因您违反本协议或规则而给第三方或TRI造成的任何损失，您应当承担全部责任。
10、TRI保留在中华人民共和国大陆地区法律允许的范围内独立决定拒绝服务、关闭用户账户、审查、编辑、删除用户内容或取消订单的权利。
八、协议终止
1、您同意TRI有权基于平台服务的安全性问题，暂停向您提供部分或全部TRI平台服务，暂时冻结您的账户，并在安全问题解决后及时恢复，并及时将暂停、冻结、恢复的事实通知您。如因您的违法行为导致平台安全问题，TRI有权终止向您提供部分或全部一室一千平台服务，永久冻结（注销）您的账户，并有权向您要求赔偿损失。
2. 您同意，您与TRI的协议终止后，TRI仍享有以下权利：
1）依法保存您在使用TRI服务过程中的信息发布记录、交易记录及其他登录操作记录。
2) 您在使用TRI平台服务过程中，如存在违法行为或违反本协议和/或规则的，TRI仍可依据本协议向您主张权利、追究责任。
九、隐私政策
1、TRI将不时在TRI平台上发布和修订隐私条款，隐私条款将构成本协议的有效组成部分。如隐私条款与本条内容不一致，以隐私条款为准。
2. 您知悉并认可，TRI可能与第三方合作伙伴共同向用户提供相关的网络服务。在此情况下，如该第三方同意承担与本平台同等的保护用户隐私的责任，您同意TRI有权向该第三方提供您的个人注册信息及注册资料。此外，在对您的信息进行脱敏处理后，TRI有权对整个用户数据库进行分析并对用户数据库进行商业上的利用。
3. TRI将运用各种安全技术及程序建立完善的管理制度，保护您的个人信息免遭未经授权的访问、使用或披露。您理解并同意这一点。
4. TRI不会将您的个人信息转移或披露给任何无关第三方，除非：
1）根据相关法律法规或法院或政府机构的要求；
2）为完成合并、分立、收购或者资产转让而转移；
3）为提供您所要求的服务所必需；
4）向您提供您可能感兴趣的任何信息或服务。
5. 您理解并认可，TRI通过推广或其他方式向您提供链接，以便您访问第三方服务或网站。当您使用该等第三方服务时，您受该第三方服务条款及隐私政策的约束，并需仔细阅读其条款。本协议仅适用于TRI提供的服务器所收集的信息，不适用于任何第三方提供的服务或任何第三方的信息使用规则。TRI对任何第三方使用您提供的信息不承担任何责任。
6.您理解并确认：为保护您的个人信息安全，我们采用各种安全技术和程序保护您的个人信息免遭未经授权的访问、使用或披露。您理解并同意这一点。
7. TRI不对用户所发布信息的删除或储存失败负责。TRI不承诺无限期地保留用户所储存的信息。
8.当您终止使用TRI服务并注销TRI账户时，TRI将停止收集和使用您的个人信息。
9. 关于用户个人信息的收集、储存和使用详情，请参阅TRI隐私政策。
十、知识产权声明
1.“TRI”、“TRI Q&A”等为TRI及其关联公司的商标，受法律保护，未经授权任何人不得使用。对于任何侵犯本公司版权及其他知识产权的行为，TRI将依法追究相关法律责任。
2. TRI平台上发布的信息和资料（包括但不限于代码、文字、图表、标识、按钮图标、图像、声音文件片段、数字下载、数据编辑和软件）均为TRI或其内容提供商的财产，受中国和国际版权法的保护。本平台上所有内容的汇编均为TRI的专属财产，受中国和国际版权法的保护。本平台上的所有软件均为TRI或其关联公司或其软件供应商的财产，受中国和国际版权法的保护。任何经授权在TRI平台内浏览、复制、打印和传播信息内容均不得用于商业目的，所有信息内容及其任何部分均须包含本版权声明。
3. 用户一旦接受本协议，即表示
The user proactively transfers all transferable rights, such as copyright property rights (including but not limited to: reproduction rights, distribution rights, rental rights, exhibition rights, performance rights, screening rights, broadcasting rights, information network dissemination rights, filming rights, adaptation rights, translation rights, compilation rights and other transferable rights that should be enjoyed by the copyright owner) to TRI in any form of information content published on the platform at any time (including but not limited to user questions and answers, evaluations, user consultations, various types of information, knowledge, encyclopedias, opinions, topic articles and other information content), and the user agrees that TRI has the right to file a separate lawsuit for infringement by any subject.
4. This agreement has constituted a written agreement on the transfer of copyright property rights and other rights stipulated in the Copyright Law of the People's Republic of China and relevant laws, and its effectiveness applies to any work content protected by copyright law published by the user on the TRI platform, regardless of whether such content was formed before or after the conclusion of this agreement.
5. The user agrees and fully understands the terms of this agreement, and promises not to publish the information published on the TRI platform in any form or authorize other entities to use it in any way (including but not limited to use on various websites and media).
6. The information or content published by the user through the TRI platform does not represent the opinions and views of TRI, nor does it mean that TRI agrees with its views or confirms the authenticity of its content.
7. The information, text, pictures and other materials published by users through the TRI platform are provided by TRI users, and the authenticity, accuracy and legality of the information publisher are responsible. TRI does not provide any guarantee and does not assume any legal responsibility.
